Photoboot (boot.small-victories.co and the Photoboot iOS app) is run by Small Victories BV, Mellestraat 303, 9090 Merelbeke-Melle, Belgium · enterprise number BE0793.301.929 · [email protected]. By using the booth or buying an event gallery you agree to these terms. How we handle personal data is in the privacy policy.
The booth
- The booth is free to use, as is. It runs in your browser or the app and prints over Bluetooth on your own printer. We can't promise it works with every device, browser or printer, or without interruptions.
- The Photoboot software is open source under the MIT licence; this site is one hosted copy of it.
- Photos shared without a gallery are deleted 30 days after they were taken. Keep your own copy of what matters to you.
Event galleries
- An event gallery is a one-off purchase per event, not a subscription. The price is shown before you pay. On the web you pay with Stripe; in the iOS app through Apple's in-app purchase, under Apple's terms.
- After payment you get a setup link for your booths and a private gallery link by email. Every photo guests keep at a booth set up for the event goes to the gallery (not the ones they retake), with a download of all of them. Photos are kept for one year after each was taken. Download what you want to keep before then.
- Anyone with the gallery link can see and download the photos, and anyone with the setup link can run a booth for your event or delete it. Keep both links private and share them only with people you trust.
- You can delete your event, with its gallery and all its photos, at any time: on a booth, Settings → Event → Online gallery → Delete the event, or mail us.
Withdrawal and refunds
- On the web, you ask us at checkout to start your gallery right away. As a consumer you then keep your 14-day right of withdrawal until your event has taken place (the day of the event has passed or, without a date, a booth has sent photos to it); after that it ends. We confirm this in the email with your links.
- Before your event: mail us and you get a full refund, no questions asked.
- After your event: if something didn't work, mail us. A (partial) refund is then at our discretion.
- A refund ends the paid gallery: its photos fall back to the free 30 days.
- App Store purchases are refunded through Apple (reportaproblem.apple.com).
Your photos and your guests
- You and your guests keep the rights to your photos. We only store and show them to provide the service, and delete them as described above.
- As a host you are responsible for the photos taken at your event: you are the controller under the GDPR. Tell your guests that photos may be shared through a link or gallery (print the booth notice and put it next to the booth), delete a photo when someone asks, and don't use the booth for anything unlawful or for photos of people who don't want them taken.
- We may remove photos or events that break the law or these terms.
How we process your guests' photos for you
For the photos taken at your booths Small Victories BV is your processor (Article 28 GDPR). These terms are our data-processing agreement:
- What: photos of your guests (which may include children), with the time they were taken, stored to show them by link and in your gallery, for the periods in the privacy policy.
- Your instructions: we process the photos only to run the service as described here and as you set it up, unless the law requires otherwise. We never use them for anything else: no advertising, no profiling, no training.
- Confidentiality: only the people who run Photoboot can reach the photos, and they are bound to keep them confidential.
- Security: HTTPS only, long random links, private photo storage that only our server can read, encrypted backups, and two-factor login for our own admin.
- Sub-processors: you allow us to use the providers listed in the privacy policy (Oracle Cloud, Hetzner, Cloudflare, Brevo), each bound by the same duties. We announce changes on that page; if you object, mail us, and if we can't solve it you can delete your event.
- Your guests' requests: we help you answer them. If a guest asks us, we let you know and remove the photo from our server unless you have a good reason to keep it.
- Deletion: photos are deleted at the end of their period, or when you delete them or the event; backups follow within 30 days. Download the ZIP if you want to keep a copy.
- Breaches: if a breach touches your photos, we tell you without undue delay, with what you need to meet your own duties.
- Proof: on request we give you the information you need to check that we keep to this.
Liability
We do our best to keep the service running and your photos safe, but we can't guarantee it. As far as the law allows, our liability for an event gallery is limited to what you paid for it. Nothing here limits rights you have as a consumer under the law.
Changes, law and courts
We may update these terms; the version on this page applies. Belgian law applies, and the courts of Ghent are competent. If you are a consumer, this doesn't take away the protection of the mandatory consumer law of the country you live in, or your right to go to the courts there.
